Manila, Philippines – Former Magdalo representative Gary
Alejano has claimed that President Rodrigo Duterte is using the two agencies namely the Department of Justice
(DOJ) and the Office of the Solicitor General (OSG) to intimidate his critics.
“It’s obvious that this administration is
using these two agencies for political persecution, to bully its critics, in
deliberate deviance of the Prosecution Service Act, P.D. 478 and the
Administrative Code,” Alejano said in a statement.
Alejano has been charged at the Department of Justice (DOJ)
an inciting to sedition complaint concerning his alleged participation to oust
the President through the creation of the “Ang Totoong Narcolist” video series.
The Philippine National Police-Criminal Investigation and
Detection Group (PNP-CIDG) filed the complaint and being represented by the OSG
during the preliminary investigation at the DOJ.
The former party-list representative, meanwhile, filed with the
CA a petition to stop the preliminary investigation and to prohibit the DOJ
panel from investigating the case.
Alejano’s camp argued that the participation of the DOJ
panel and OSG in the sedition complaint investigation, violates the Prosecution
Service Act, the Administrative Code, and Presidential Decree No. 478, which
specified the powers of the OSG.
“It is our position
that the Court should intervene to stop this continuing and deliberate
disregard of the law,” Alejano added.
The inciting to sedition complaint filed by the PNP-CIDG was based on the testimony of witness/respondent Peter Joemel Advincula alias "Bikoy".
